Administration Trust
Through this contract you can transfer all kinds of goods, whether these are movable, immovable or intangible, so that TrustSmart manages them and strictly complies with the instructions established in the contract. The reasons why the Administration Trusts are made are given both because the trustor (who contributes the assets) is limited or unable to exercise direct administration of his assets; for the convenience of separating assets for specific years, by agreements between the parties of joint investments, and in general, for any other reason under which a person wishes that a trusted third party company administer and guard certain assets in an expedited manner and with the minor risk.
Guarantee Trust
Is the fiduciary business through which a debtor puts one or more of his assets as collateral for his credit in the name of the Trustee, and in favor of one or more creditors; In this case, the Fiduciary will have precise instructions on what to do as soon as the debt is canceled, or otherwise, how to proceed to auction off the property or assets that were given as collateral, through a private and agile procedure to obtain credit satisfaction in case of default.
Testamentary Trust
It is the one where all or some assets of those who wish to establish their last will are transmitted to a fiduciary third party who will maintain their ownership for the term that the testator wishes, normally, until the moment of his death. When this event comes to fruition, TrustSmart will follow the instructions in the handling and distribution of the assets. These types of contracts, like ordinary wills, can be revoked or modified at any time the testator wishes.
Contract for the management of rentier resident funds
Through this contract, the funds that those foreigners who are choosing to obtain a residence as rentiers in Costa Rica, may deposit the amount that the General Directorate of Taxation requests as a guarantee, in an individualized TrustSmart account. By virtue of this, the resident will have, according to the specifications of the contract, a greater control of his funds, of the disbursements that are generated, and in general, greater capacity of control than in the banking products that are offered for this service.
Escrow Agreement
Through this contract, a person will transfer funds to TrustSmart, destined for a specific business, with specific instructions on the time or milestones in which the funds should be transferred to one or more people. The contract essentially constitutes a simple intermediation of funds, in which all the parts of a given business will guarantee that a reliable third party will transfer the agreed funds just at the moment in which the specific facts that motivate the contract are fulfilled.
